Couriers & Claims
« on: September 30, 2015, 12:39:19 pm »
Wanted to share my story with everyone to see if anyone has any advice or help on my situation.

I sent an exhaust system with a courier to be sent back to the manufacturer to trade it for a different one, with the agreement that I ship them the exhaust and once they get it safely, I pay the difference and get my replacement. However, upon delivery the company informed me that the exhaust had been damaged in transit, that the packaging was a total mess and that it hadn't even been delivered to them, but the business next door.

Raising a dispute with the courier, they will only accept up to £200 liability saying they don't pay out for any more than that. They also threaten that because I didn't start the claim within the 48 hour window and that the package was signed for as fine, I might get nothing. They have also said that within their terms and conditions, they are allowed to deliver it to another address if needs be.

My argument to them is that I wasn't informed in time by the receiver as it wasn't delivered correctly, plus that it's been clearly mistreated while in their care and therefore should be paid out the full VAT invoice amount.

Has anyone else had trouble like this and what was the final outcome? Right now I'm over £1050 out of pocket and plans for my Golf R have been delayed by over a month now because of this. :sad1:

Why would the company next door sign for the parcel instead of telling the courier he'd come to the wrong place? Also why would they sign for a package that was damaged especially if it didn't belong to them?

My dealings is you need a lot of before and after shipment photographs for evidence - they have a limit typically what you quoted and to get more out of them takes nothing short of a miracle, if you haven't paid the extra for full value cover!

I get this problem at my work all the time COURIERS get out of everything amount of parcels that never turn up to my work is incredible with peoples names that never worked for me in my life. Also had lots of courier drivers signing for parcels them selves and not delivering it. They have crazy targets to reach and under serious pressure from their companies so they do everything they can to make everyone happy.

Good luck trying to get £1050 from them i personally think you will be the luckies person in world if they pay full amount  :signLOL:

Sorry to hear that mate

Well this is the thing, I have many photos and a statement from the owner of the exhaust company in question (trust me, no-one on here would question their reputation) showing the damage and saying that no one at the right place took the delivery. I've contacted citizens advice buearu regarding this so will wait to see what they say.

I kind of feel that given enough pressure and possible small claims court, I can prove that they damaged my goods and didn't take proper care or meet the basic requirements and thus owe me a full pay out. I'd rather be patient and win than accept a low pay out and just have to be out of pocket.
