The gear speed indicator is (at least on my Scirocco) worked out on revs / speed. Doesn't actually take into account anything else. No electronic or physical gear position indicator so to speak. If you are precise with the revs you can hold it at the right speed and it will display you being in a gear when you are actually in neutral.

So that points to a possible electronics issue with a wheel speed sensor or a rev sensor. That being said there is a whole subroutine that goes on behind the actual displayed revs on the dial to even out variations. It only takes a few hundred rpm to be wrong.
Although it is very strange that it doesn't work for 5th gear. Is the gearbox on the car the stock gearbox? Has it had a longer ratio gearbox installed? On the Mk4 and Mk5 5 speed boxes it wasn't uncommon to fit a T4/T5 5th gear ring to reduce the effective final drive of that gear for better economy.

I hate to say it as it's really sh*te half of the time but have you scanned your car with VCDS to see if there are any faults.
You can also live log the cruise control.

As you say it's come into work I presume you are a mechanic so do I get a % of the repair cost if I figure it out?

Thanks
We have had nothing put problems with the car I did the gearbox on it for a recon box and then it was making a grinding sound so hat to take the box back out, and it was down to the place we send our boxes to had done something wrong, then when I refitted it it jumped out of. 5th all the time so he came out and  realigned the 5th gear or Somthing and now this lol

Cheers for ur replay, I have scanned it with snapon scanner but I am taking my vagcom in tomorrow

Haha I wish I got payed the labour rate haha

Sounds like 5th has a different ratio... a number of the VAG boxes have a different ratios depending on gearbox code. If it's even slightly out from the what the ECU is expecting then the CC simply will not work. I don't think there is anything in VCDS that you can do as it's in one of the many many maps within the ECU. Here is a list of the yeti gearboxes and different gear ratios: http://workshop-manuals.com/skoda/yeti/power_transmission/gearbox_02q/technical_data/identification_of_the_gearbox/

Who knows what gear was used, from any one of the VAG range available, but it sounds like you'll either need a gearbox change, or someone mightily clever to adjust the ECU map

Right, so as Dan has suggested it sounds like the box replaced has an incorrect set of gear ratios on it.
You will need the exact same code of gearbox or another with the same ratios.
That will be your issue.
