I have 06 gti and took it smith knight fay for mot and they failed it on the high level breaklight on spoiler and said it needs to go body shop for the cheese wire treatment . i said it was an optional light (3rd) and doesent matter as the main two are fine  and they said because it was fitted by factory it has to work to pass mot i think this is a load of b sh1t or is it true

It's true.

If the car was factory fitted with the third light, it absolutely must be functional.

Furthermore, AFAIK all cars nowadays must have a third brake light from the factory.

My last car had a high level break light, it never worked and I didn't get as much as an advisory on my MOTs.

....You will find that MOT requirements are being continually revised and made stricter.

regarding led lights vosa says at least 50% must work or it fails
