I have just hit a pothole - Now with photos of the Monster !

Hi All

Just need a bit of advice, driving home tonight I was going along at 30 and hit an almighty pothole ! It must have been recent as I drive the road everyday, after it happened I turned around and had a proper look and it is enormous, it was pitch black so going back tomorrow morning to take photographs.

But, my question is, if it has caused damage (which by the sound of it, it has) is the claim against the highways agency, as surely that is what our road tax is partly towards ? Or is it just tough luck ?

Any thoughts or advice would be greatly appreciated.

Ditto. Get pics asap, as they'll fill it in as soon as someone complains. Ask for a claim form and you send that back with a receipt for any work you had done  (they only pay you back afterwards on proof of repairs).

as above mate, take some pics with a measure to show depth/width.     the roads round my way are shockingly bad at the min, its like driving on the moon with all the craters

I think if its that new, and no one has reported it you will be out of luck as they will say they didn't know about it and so didn't have the chance to fix it.  Which is sensible enough.  I think there is a reasonable timeframe allowed for them to fix it.

You should NOT consider reporting it and adjusting your claim to suit ...  :innocent:

Don't know if it was reported already or not but last year I hit a pothole and damaged 2 tyres.  Notified the council they sent a claim form and I had a full reimbursement within 6 weeks

I think you have missed my point ...

If the pothole has not been reported, the council or whoever will have a defense in court that they could not have reasonably know about the hole hence why they didn't fix it.  This defence might be weakened if it can be proved the road had not been inspected for a long time.

To ensure this is not a suitable defence, an enterprising claimant might ensure that the pothole was reported prior to making his claim.  Obviously a period of time should elapse between reportage and submitting claim.  This would of course be fradulant and why you shouldn't do it.

No. You still make no sense. The hole wouldn't be there if they did know about it, as they would've mended it! Not knowing about something isn't a defence!

What he is saying is that if Stefan wanted to he could:

Report the hole Today. Then claim for his car on Friday. However as has been pointed out by both of you:

1 - That would be fraudulent.
2 - The hole would get filled in potentially leaving Stefan without a claim.

You both make a vaild point but can we keep it from turning into an argument  :drinking:

If i were you i would just follow the course of action you are i.e take pics, report the hole and make a claim. :happy2:

No argument, boss. The OP asked for advice and I'm merely pointing out that some of it is incorrect.  :happy2:

I've claimed off councils before, you get your evidence first (photos), report the hole, ask for a claim form at the same time and then get your car looked at. Any damage you send off the form with receipts for the work done, no damage form can go in the bin.
