MY golf got crashed into :(
« on: May 04, 2011, 05:11:51 pm »
I have a Gt tdi which was crashed into the other day while i was stationary at the traffic lights.
He admitted everything and he also hit someone else too. He payed the other person there and then since it was a minor scuff but my car in not drivable.
I have a courtesy but they are saying he hasnt reported it to his insurance and he has cancelled his policy after the accident.
A witness statement has been sent to the other driver.
HE cant get away from this can he, they wont repair mine until liabilty is established.
Can he keep ignoring??
Thanks guys

Have you reported it to the Police? The main thing is he was insured at the time of the accident so the company will still have to pay. Get your company to report it to his and start proceedings.

They should be keen to sort it as the longer you are in a courtesy car the more its going to cost!

I assume you have identified any witnesses / looked for CCTV?

I'd report it to the police and see if they can do anything. Did you take any pictures or anything?

oh and the police said let insurance co sort it as they do this stuff all the time for a minor bump its a waste of our time coming to it and to honest at the time it would have been as the car had a cracked bumper and a dented exhaust

Often there is little point in attending if there are no injuries and road not blocked but accidents should be reported if s.170 of RTA is not complied with or other offences e.g. no insurance.

These can be investigated after the initial accident and the offending driver interviewed and summonsed etc..

The car was insured at the time and police said they didnt need to attend as he gave me all his details.
I have all his details, pictures and witnesses.
He just cancelled his policy and ignorning letters etc... The claims company is chasing it
What usually happens in this case?

You should be alright, If he was insured at the time at the accident then the companies will sometimes pay up front for the repairs and then argue over who was at fault.
Even if he wasn't insured at the time there is a 'pot' that all insurers pay into in the case of no insurance crashes, (think there was a pot for the accident  claims too, but that's probably more of a skip now!) :signLOL:

Hope you get it sorted promptly mate.

Thank you, all the evidence is there against him with witnesses etc
What happens if he just keeps ignoring letters? His car was definately insured at the time, dont know if he was though. If he lied about his age or something, in this case would they still pay out?

Why would someone cancel their insurance after an accident?  Doesn't make a lick of sense to me ...

Just wondering does anyone think he can get away by just keeping on ignoring.
I am so angry, why do honest people pay insurance when he can just ignore everything after?

Sorry to hear about this, have you reported the claim to your own insurers?

They can use the MID (motor insurance database) to establish it he was insured on that day. Assuming he was covered they will usually give him a period of time to respond to a series of letters before deciding whether to deal with your claim.

Worst case if they will not deal with your claim you can try the MIB (motor insurers bureau) via the uninsured drivers facility, this does have an excess of about £300 though from memorary.

Yeah the car was insured on the day of the accident. Now wether his name was insured is a guessing game.
I just hope he cant get away *sigh* I am only third party so a no win no fee company is after them (As much as i hate them i have no choice as im third party)
