Bailiffs and recovery of Money
« on: June 23, 2011, 09:20:58 am »
My Son ordered a pair of MK4 Golf Headlights from Essex Racing for £199 plus £10 in March 2010 and they have failed to supply the goods or return the money and we have taken them to small claims court. Our case has proceeded through to the stage where Bailiffs have called at their address and failed to gain access.

So what next?

There are added costs to the initial claim which are the £30 Court fee and £100 issue of warrant fee. Total £339. I will persue this matter until we get the money back. If it costs me thousands i will continue as this company has been ripping off the youngsters for years. They are still trading ! What have trading standards done?

I am sure the Bailiffs should return until they have exhausted all options. Do they have a shop/office thats open to the public?

You can get the building up on google earth and looks like there is access up the front. Bailiffs can be really good or waste of space in my experience. The ones employed by the courts generally are poor. They don't genrally like difficult work
Courts have to notify the person/company they are calling on before they come aswell , stupid  TO TELL THEM YOU'RE COMING !

Get the court to issue a CCJ (County Court Judgement) This makes things a litle more difficult for them trading wise, plus what ever the costs, you'll get it all back...when they finally cough...good luck.  :happy2:
Cheers,

Wayne

He paid by DEBIT card unfortunately. They never have acknowledged any court papers or appeared at court etc. Can you issue CCJ against a Ltd Company?
