Just back from the VW dealer.  £2000 for new Mechatronic (fitted).  Ouch!!!  They need to run a diagnostics to confirm that's the problem then send a note to VW UK asking if they are prepared to contribute to the cost as a goodwill gesture.  So, no guarantees, even although the car was owned by VW for the first six months of its life, full VW history and less than 20K on the clock!

I'd still be pushing to see what your seller's liability is. They can't claim a 3 month warranty anymore. Any registered motor trader has to offer 6 months on major defects on appropriate vehicles. That means that although you'd not get this fault covered on a mega-miles £800 crock, it is appropriate in your case to seek redress vs the seller, if you bought within 6 months.

Check your local trading standards & Citizens Advice. Under the Sale & Supply of Goods Act (Consumer Regulations 2002) any motor dealer must warrant their vehicles for 6 months from the date of sale. Note that in such instances the onus is on the dealer to prove that any fault arising was not preexisting the sale. Otherwise the seller is essentially liable.

Latest update.....


as suspected, Mechatronic Unit is f*cked...£1600 plus fitting.  Also small fan packed in causing the larger one to operate prematurely with a loud noise.....also needing repaired.  Letter has now been fired off to VW UK for a goodwill payment.  Car has less than 20K, 3-1/2 year old with full VWSH...in fact the car was owned by VW for the first 6 months of it's life so will hopefully get a positive response.

You need to be following this great advice. I dont think VW will be offering you too much, even if they go halves you still have a nasty bill.  :happy2:

Mine plays up a bit when hot. doesnt seem to disengage second gear quick enough before going into 1st. Had oil change on schedule also had dsg reset.
No error codes so Warranty Direct wont authorise repairs.

Thanks guys. To the original poster, my advice is as I posted. Your dealer is liable. The onus is on him/her to prove the mechatronic fault wasn't present at sale, providing you purchased this vehicle within 6 months. You can pursue claims after the 6 month period, but then the burden of proof is on you to prove that the defect was present.

So don't leave it any longer. Follow the Citizens Advice link I posted. Stop using the car (very important), and contact the dealer immediately by recorded delivery letter. Tell him/her that you intend to hold them liable for this fault under the Sale & Supply of Goods Act, and give them 7-14 days to reply. Tell them without a satisfactory reply you will pursue them through the Small Claims Track of the County Court for the total cost of repairs, plus out of pocket expenses.

If VW UK know that this dealer is within the 6 month period they will (rightly) refuse liability of their own.

Don't back down. :happy2:

Well, after writing a strong letter to VW UK, they agreed to pay 100% of the replacement Mechatronic Unit, complete with a 2 year warranty...result.  I did emphasise in my letter that VW are well aware of this DSG problem and have offered their US and Canadian customers a 10 year warranty.

Local VW dealer was first class, had no issue with them whatsoever.   :happy2:
