Someone bashed into me :(
« on: February 04, 2012, 09:44:09 pm »
I was legally parked on a road, no cars in front of me so when I took off I was going in a straight line.  Unfortunately an Izuzu Trooper pulled out of a parking space on the other side of the road at the same time, crossed over to my side and as I had started moving he took a chunk out of my wing and scuffed the bumper pretty good.

Honestly not sure who's at fault here, he crossed onto my side of the road but he says that when he looked I was stationary.

Anywho, have reported it to my insurer.  In the event its partially my fault how much of my no claims am I likely to loose?  Have 6 years at the moment.

Is it worth getting an accident management company involved?

The Trooper doesn't have a scratch on it  :signLOL:

If he's passed onto your side of the road mate i'd say it was his fault. Even if when he looked you were stood still he wasn't being observant enough to notice you had moved off. You did get his details didn't you. Insurance company should be able to sort this out for you anyway. :happy2:

Yes got his details, he was quite apologetic and seemed to take the blame at the roadside.  Felt quite sorry for the bloke as he was an older gent and even though it was no more than 5 mph I think he was a bit shaken.  I'm sure by the time his insurance co get onto it there will be a different slant to things.

sh*t happens, at a push I'm happy enough to pay the excess but don't want to loose all my no claims.

I should probably clarify, when I say he crossed onto my side of the road, he was crossing onto the right side of the road for the direction he was travelling in.

If I'm following correctly still his fault. You were stationary when he looked which begs the question of how long was it between his look and him pulling out. Sounds unlucky for him to have a parked car pulling away at that exact moment but that's why you have to look, look and look again.

If its his fault you may have to pay the excess but should get it back.

If he has apologised then he has admitted liability. FACT. I have just been on a training course as i drive for a living and thar trainer said you should never say sorry , are you ok, as doing so you have admitted liability.

Yup should be easy to reclaim your excess from him if you have legal cover included with your policy.
Also if the insurer accepts it's his fault then you shouldn't have any worries about losing any of your ncd.

Sadly not, had to move the cars to let traffic past.

Thanks chaps, will see what the insurance lot have to say.

On the plus side there was a tiny scuff on the bumper anyway, not worth sorting in its own right but at least it will be sorted now!

Did he mirror and signal to indicate he was leaving the parking space and crossing the road? If not, you won't have been able to notice his manoeuvre anywhere near as much. TBH if he didn't, I've little time for him on this one.

Hopefully you did too which should help your cause :happy2:

I had to pay the excess when some twonk bumped into me.
Bleeding Insurance company stitched me right up too. I thought my excess was £400 but it turned out to be £800  :surprised:
£400 Voluntary excess (which is all I was expecting) plus £400 Compulsory excess WTF

Anyway….long story short, I got my car fixed and back within 7days. They wouldn't start the job until they received  the £800, so I paid up thinking, I'll get it back soon, being a non fault.

Ha! took 19months to get back  :stupid:

This is why I'm wondering if I'm as well to throw my lot in with an accident management company and let them take the strain but in principle I'm against the likes of these companies that inflate claims for no good reason.  Got £150 voluntary excess and £350 compulsory so expecting to loose that short term.
