Who is at fault

My car was parked outside work a couple of weeks ago and a piece of tin that was laid on top of a skip flew off and hit my car it was laid on top of a pile of rubbish in the skip.

The company that own the building that were renting the skip have put it through there insurance and liability has been refused.

Saying that it was due to high winds.

What do I do now

What was the wind speed that day ?Okay if it was a hurricane but if it was gusting 10 mph then the tin should have been secured better.

Fight it they have to prove they placed the piece of metal securely. Even if they're insurance declined they could still be liable

The insurance company is hoping to fob you off. Find out what the wind speed was that day and hence confirm it wasn't an act of god and therefore that the skip company did not secure things properly.

Don't give up on it yet. Take photos of generally how they don't secure stuff properly - Most skip companies are a bunch of people who don't care two figs about anyone else - Commercial pikeys!

I agree. I had a number of skips outside my house recently and it never ceased to amaze me that people would park right up to them. I was obviously careful to secure the contents, but you can't stop dust blowing off it.

What was the damage?

I was parked about 20ft away from skip which was in a parking bay. There is no where else to park in the area. If my car was further away would of still hit it or a customers 40000 van parked a few feet away from mine.

There was a 3ft peice of tin that had been put on top the skip between me parking there 6 hours later when I parked there.

It was a bit gusty but it always is where we are on the causeway to Portland.

I'm not someone that wants to claim this that and the other for stubbing my toe at work or some bullsh*t. If it was the other way round it would be are fault if it came from are yard.

Had a couple of quotes and it's about 650 ish to repair. If it was a couple of hundred I would probably give up now but don't see why I should. I didn't put the metal in the skip or put the skip in a parking bay.

There is act of god if a tile fell off a roof or a tree fell on it but was just something that with a bit of common sense could of been prevented I took pictures of the skip and one of my customers witnessed it. 

Sorry don't mean to rant. Just a little pissed off.
Car will be away for a few days for development next week and wanted to get it straight in to be repaired but don't wanna get stuck with the full cost of it.

Sounds like the skip users have clearly been negligent and I would definitely keep at them. See Citizens Advice Bureau perhaps? Do things in writing so they realise you are being serious.

There a local company that have moved it to new premises. One of my colleagues is friends with the director so don't want to pick a fight with them just want what's fair.

Don't wanna get solicitors involved never worth it.

but 600 quids is a lot of money for something that's not my fault

Then ask your colleague to have a word with the director he's friends with and see what can be done. But if they don't want to help and you don't want to take it further, then you'll have to just forget it and move on. But for £600 I think it's worth taking it further if necessary and being seen as willing to do so. It's not a personal issue so it's not about picking a fight.
