damaged rim can i claim

my gf is so pi##d she went down a damaged drain and ripped the side of the tyre wall nd dinked the alloy.
i have seen programme about i can claim against highways for it... anyone got some advice/help/experience.

we have taken pics of everything and will be taking this as far as we can

There was something on Fifth Gear about this, providing you have plenty of pictures and it meets there requirements I dont see why not.

I remember the pot hole being so deep and wide, same may apply to the damaged drain.

Best thing to do is contact your local council for a form and report the drain. It can go either way.. they can be as nice as pie and help you out... Or they can turn round and say you have no proof the drain caused the damage... Good luck!

My b/f damaged his car recently on a raised manhole cover.  He reported it to the council and very soon afterwards cones appeared round it, then within hours the hole was filled in and the manhole cover straightened up.  Get plenty of pics, contact the council and they should send you a claim form :happy2:

thanks guys thats what we plan on doing esp my gf works for a bloody council...
have also found a great website for everyones future reference

Did this recently with my local council.  There was a pothole around a drain  and both the left hand wheels of my wifes Lupo GTi went into it and damaged the edge of the rims and a quarter of the way up the spokes.  Called the council and within a day it was repaired. Waited a fortnight for the claim form but didn't get it. Called again and was told there was no record of my initial complaint !!  I said " isn't it funny how it was repaired the following day then".  They eventually sent out a claim form which required quotes to replace or repair and all the usual details of the incident.  I sent this in , it was acknowledged and sent to their solicitors in Cardiff. I had a letter from them to say that under the some section of the highways act that the council have to prove they have an adequite maintainance schedule and that if it was ok the last time it was checked then they didn;t have to honour the claim.  Their schedule requires a check every 6 mths !  Now, this section of road was one that suffered badly during the last winter when the temperatures dropped to unprecidented levels resulting in a badly potholed surface.  I then asked, under the freedom of information act, to have a list of all the complaints received for that section of road.  In the area of my pothole there were many complaints of other damage so I am now taking advice on how to persue this further.  I'll keep you informed but , suffice to say, its not as "open cheque book" as you may think.

mate- check the potholes website- you are doing nearly all what they say to do,so good on ya!!! :happy2:

Yeah, read that after I posted. Good site. I'll write to the council and ask for their maintainance schedule in detail. I'm hoping there's a clause in there about extreme weather conditions.  Fortunately for me the wife is a legal exec !!
