55 plate paint advice

Hi all i bought my gti in February from a main dealer not Volkswagen but when washing the car found rust on the rear arch and around the boot badge and the paint is flaking in the door shut . Vw tell me they cant paint under warranty as the panel has been resprayed at some point would i have a leg to stand on if i went back to the dealership i purchased from.

You can only ask  There's plenty of wiggle room for them to wash their hands of it (i.e. we didn't know, it was before we had the car etc), so I'd ask nicely and see what they say.
