Successful claim againstt pothole damage
« on: June 04, 2015, 11:20:04 pm »
Has anyone had a successful claim against pothole damage?
Hit one tonight at around 25-30mph on country lane.
Cracked my windscreen and blew one of my front tyres out within about 20secs.
I hit a few potholes in the past in previous cars and only really knocked the tracking out or had to have the wheel rebalanced so not the end of the world, but this im really pee'd of about, Just wanting to know if others have been successful with a claim.

The same think happened to us last year (not the windscreen though). We contacted the local council and they sent us a a 16 page form to fill in, well not really 16 pages but it was a bloody lot. Anyway They told us that as the pothole had not been reported previously then them were allowed a certain amount of time to fix it before they were liable. I dont actually know if thats true but you can also check council records to see if it has already been reported by anyone else, if it has then you have a good case.  Its a real pain in the arse when this happens.

This is one of those times when you question your battles...I hit a pot hole hidden by standing water that damaged two wheels. I reported the situation as soon as I got home. They mentioned that signs were posted and I disagreed. I hung up the phone and went directly back to the scene where I found the highway crew just then placing signs. I put all of this in my report only to be denied and informed of my rights to Appeal. They want you to go away " . "
