Title: Bit of legal info please.
Post by: Gene Hunt on December 29, 2010, 03:35:28 pm
Got my ED 30  last week.  :jumpmove: Phone has just gone & salesman has phoned to say ''sorry but we need another 300.00 off you'' as the part ex/gap insurance deal we shook on has upset his sales manager.
Basically i  told them what i wanted part in part ex & they came back saying i was 500 adrift with there price etc. I said i need that amount to make the car affordable so saleman said ok we will stand the gap insurance in effect giving me the price i wanted for my car.
Signed all papers last wednesday & drove car home now this today.
Should i just tell them to go f**k which it think i should as last week they went through all the papers as they were signed so to me it's there fault ?.
I think the salesman has dropped a bollock & had a telling off & now trying to make me pay for his mistake, even his salesmanager went through the papers as they were signed & he faxed them off to the revelent people.
Thanks in advance.
Steve.

If you signed papers for the agreed amount, then as far as I know, they haven't got a leg to stand on. Tell them to swivel.

You have signed and paid the invoice amount, their mistake - not yours.

Andrew

edit,

Agree with Robin below about being courteous, manners cost nothing and as Robin said, you may need their services in the future, but still stand by your guns.

Except that I'd be polite and charming and say sorry but it's not your problem and you can't afford to pay for their mistake. No point in being rude to them - You never know when you might want a favour or help in the future.

Isn't this your car? Why have they re-advertised it?

I would tell them that I couldn't afford the extra £300 and ask whether they wanted the car back instead?

It may be a bit risky since they may say "yes", but I doubt they'd want to lose the sale for the sake of £300.

Robin's got it on the head. If you bought a loaf of bread & some beans at Tesco and were undercharged, the management have no redress in contacting you to say you underpaid. I certainly wouldn't come over with a story of not being able to afford it as the previous post advises. Be firm, but be polite, with an air of knowing where you stand. If you aren't sure, your local Trading Standards dept are very good at this sort of thing. Even better is www.honestjohn.co.uk the champion of car consumers' rights. You can expect a swift email reply.

If you are in posession of the correct paperwork, including a receipt, then there's precious little the dealer can do. It only strengthens your position if the salesman & his manager have both dealt with the paperwork. Although I'm disinclined to believe the salesman's "I made a mistake with the price" sob story, even if he did, you cannot be held responsible for that in any way. Just explain to them that ,as they know, much of the profit in cars these days is in the hearty labour charge & warranty work that dealers carry out. As a loyal customer, you'll be happy to patronise their parts/service dept, but you certainly won't if they want another £300 off you.

Bottom line, like Hammer said, they can't touch this

Thanks for the replys guys.  :happy2: Just about what i thought & ''yes'' i have all the correct copies of the paperwork at home.I'm at work & didn't want to go in to details there so the salesman is calling me back tomorrow so will use the advice given here & stick to my guns

As all above they have nothing they can stand on.

The deal is done plus I used to sell GAP insurance as a salesman which we sold at £295 and the cost price was £76.45! So that is a big margin in the product so they are just trying to reclaim the profit on the car!

Lovely looking car and I hope you enjoy it!  :happy2:

This sounds familiar, had the same experience when i bought a Jetta in October but in my case I was under charged by a little more than £300.

If the sales invoice states the amount you have paid and the transaction has been completed there isn't much they can do apart from ask politely for you difference.

Well the dealers called me today & told me they were ''very sorry'' it was there mistake & not to worry as everything is sorted. :happy2:
Reason it was showing as still being for sale is they use an agency for there advertising & they had closed over christmas so no one to remove the advert off some of the other sites the advertise on.
Dealer told me the phone has not stoped ringing for the car, good job i got in when i did.
Again thanks for the good advice.
