It doesn't matter.  The Police don't need to prove anything. They know the plate of the speeding car. 
If the registered keeper fails to declare who was driving, they get slapped with an obscene fine, a bucketful of points and a nasty chaser of a MS90 code on their licence.
Try an online quote for a laugh with that conviction code...
It's only worth "not knowing who the driver was" if you were going really, really fast.

In the OPs situation, he needs to prove that the car the Police think they have, is wrong.  Again the Police don't need to prove anything, the onus is on the keeper.
He can do that by contacting them and supplying them pics of his car showing the differences.  It would be also worth reporting it on 101 so that they are aware (and then carry the V5c in the glove box for when ANPR flags it up and he is pulled over for a chat.)

Thanks for the advice and pointers guy's I'm going to send an email explaining what's happened and requesting all the evidence they have as I'm really confused what to do next. Everyone is saying I need to prove I wasn't driving but this is kind of hard when you were in bed sleeping over a 100 miles away, I've never even been near to Hampshire I honestly thought it was addressed to the wrong person. I'm hoping they caught the drivers face on camera and they can easily see it is'nt me but I have a feeling that's easier said than done as people lie about not speeding every day and they might just think I'm another one of them.

Wifeys Nissan Micra was cloned a few years back....red, basic, so not difficult to do! Brought car nearly new from local main stealer.

Was caught with numerous parking and speeding fines in London area, over a period of several months, and it was a right palaver to try to sort out. We lived in Cornwall. Tried explaining we were not in habit of driving to London and parking said Micra on red routes etc... Occasionally several times a week!
NOT impressed with the apllied intelligence and common sense of our boys in b!ue! As ever it's an  easier (and safer for them?) nick for them to try to nail the law-abiding general public than b!atant villans. Their argument went that we could have lent the car, etc...
 Clone was eventually written off in an accident on M4 flyover...coppers even questioned that, but yet again due to our professions, it was simple enough for us to prove where we both were, but more importantly where the actual REAL car was....we still had our undamaged car. That closed the matter for good. I sold the car, asap!

IMHO yet another example of how decent folk support the crime industry, both sides of it! The scam could be easily stopped, if they REALLY wanted to. Control access to reg plates!

Just one example, Sherlock, ...who do you think these​ people might be who seem to be confident enough to whizz past, overtaking me at 70+, when i am pushing my  luck at 55 in a 50 roadworks on the Mway? Maybe worth a pull?  :thinking:

So OP, you will have to prove where the car was, or that the offending car was not yours; they will still come after you if they believe that you are the "keeper".

Thanks I've had a read and they could of misread the plate is another option I'm hoping it's that instead.

I can see how that was a nightmare they obviously don't have any common sense because they should of been able to come to the conclusion somebody driving into London from that far away so often is absurd, I'll keep you all updated and let you know how I get on, thanks for all the help and pointers.

This sort of thing is very common in Coventry. My area which is fairly decent, has welcomed some morons that I've seen exchange number plates with a driver of a different car every other week. Your plates aren't safe even if your car is on the drive at night. If you notice it missing assume the worst, that its been stolen and notify the police straight away.

What a pain in the arse!

As far as fixed cameras go, if they don't have a picture of the car the plate is registered to at the DVLA, then they haven't got a leg to stand on.

If it was a road side speed trap, then it's up to them to prove you were driving, and if they didn't record the make and model of car, again, no leg to stand on.

That's what I'm thinking I'm in such a shock I couldn't believe it. Hopefully it doesn't come to it but if it goes to court luckily my Mom was off work so she was home and my nan was there. So they both know I was fast asleep in bed. Lucky that I have two people who can account for my whereabouts.

I'm going to try and get it sorted today and look up some contact details for them if not definitely Monday .
My cars a bit unique anyway with the front splitter black alloys etc so I'm hoping they have a picture of the car so I can prove it's not mine

I reckon you'll be fine.  Even if your plate is on 2 identical Golfs, we still have unique VIN numbers to fall back on, and you can't get that from a pic online, unless it's an inside job at the DVLA, or a dealer etc.  Without catching the offender, it's going to be very difficult to prove your VIN is the guilty one!


Ummm. VIN has no link to speeding.
It's all done on VRM.

More people see your car on the street or driving to work than look at them online so blurring photos of your numberplate ETC is a pointless and wasted exercise, but if it makes you feel better......

If it happens and you have proof of your whereabouts, EG being at work or a shop receipt from that day at a time/location that would make the indicated speeding offence impossible, you will have NO issues.

I know was so glad when the lady said the two cars aren't even the same make and model  :signLOL: now I can get on with what I was doing with the car now, its going up for sale not going far though just swapping over to a 5 door
