Flashed by Camera when driving under limit?
« on: January 03, 2013, 04:13:36 pm »
Hey all,

Some help needed to ease my mind. I was driving down a road I use daily and saw the 30MPH camera had been lowered down to the ground and had a van and a bunch of guys all working on it. I drove past it at 28mph and looked in my rear view mirror to be horrified when I saw it flash me twice? Haha.

Any ideas why it would have done this and how I would go about disputing this if I do get a ticket. I know I'm legally allowed 35 before it triggers. Will they notice its a faulty camera/reading before sending the ticket out or will I have to wait and dispute it when it arrives?

Cheers,

If it goes off for everyone going past then I would guess by the sheet number of people they would suspect a problem. But at the end of the day. It's a waiting game. Just see what happens. You will more than likely be fine :happy2:

Why are you legally allowed to be doing 35mph in a 30mph zone?

Because the law states you are allowed 10% plus 2MPH over the legal limit before you can be issued a speeding fine to allow drivers some breathing space.

If it was lowered down and being worked on I doubt it was in working order, they might have been testing it!

Plus, if you were going under the speed limit the lines on the road will show it when they measure it on the photos!

Dont worry!

Theres a camera near my way that if cars going the other way are going to fast it goes off and gets people on the correct side, if that makes sense! I have been caught like that before and never got anything through the door :)

If you actually receive a ticket you should be able to easily dispute it as your distance covered can be checked against the marks painted in the road and therefore distance divided by time between each picture will equal your speed  :happy2:

Cheers everyone for putting my mind at rest. :) Yeah I thought that with the lines but I had to drive almost in the middle of the road as the repair can was blocking part of the road so not sure if my wheels were directly on top of the lines & of course the cameras view wouldn't have been too great because it wasn't raised.

Cheers everyone,

So Ive been sticking to the 30mph limit when I could have been tearing around at 35mph

Legally you can't, but most Police forces adhere to guidelines that allow you to do 10% of the speed limit, plus 2 mph. In reality you can be prosecuted for doing 1 mph over the speed limit. Bit daft taking the risk IMO.

Cheers,

Presuming you were going 28MPH.... sometime the cameras are set to "TEST" by where they will go off with every passing vehicle. Sounds like what happened here. Unless porkies about your speed...

So why have 30 mph speed limits then and not just say 35mph but if you break this one we will really prosecute you.

My mates missus got done in Wales where they have no tolerance and probably a different wording in their Highway Code to reflect that...

Yer the 10% + 2 is just a guideline. If they want to prosecute you for doing 31 in a 30 they can

Not that I'm aware of. When I got done by Thames valley police I went on a speed awareness course mad one of the girls there had been caught doing 31 in a 30.

The instructor laughed!
